Tampering with evidence if you know or should know that an investigation is ongoing - just deleting the evidence itself - is a crime. Doesn't mean what you got rid of is going to incriminate you.
Sometimes legitimate victims do delete texts, emails, etc., from an abuser because they're so upsetting to have. They'll keep reading and agonizing over them and maybe eventually just delete them so they stop torturing themselves. Obviously that can hurt in a later case.

Charging him with what? Pleading the fifth? I don't think that's a crime. The story on AP mentions that the police had the phone at some point and returned it to the accuser's father, but no one except the officer remembers that happening and they can't find the phone. It mentions there is a backup of the information on the phone that is available, but Spacey's lawyers want the actual phone.

The fucking POINT is that even deleting anything pertinent to the case in any respect is ITSELF A FUCKING CRIME and he didn't need any other weird stuff on his phone to be in legal jeopardy. jesus christ how many times do I need to say this?? Immunity is rarer than people think because it often blows up in the prosecutor's face. My local prosecutor's office has a blanket ban on immunity - including critical witnesses in murder cases! - because it's something that has to be disclosed to the defense and it looks terrible for the witness' credibility. I think it's a lot more common in federal cases.
