I don't understand how they are allowed to sell the game with an M rating while having the uncensored adult content in the game at all. Grand Theft Auto: San Andreas had to do a recall because there was adult content on the disc even though it was inaccessible without modifying the game. If the patch for Agony just unlocks content that is in the game files, I don't think the ESRB will like that, and if you have to re-download 3/4ths of the game to play uncensored that would be pretty annoying for gamers.

Looked into this more; it sounds like they are hoping to mostly just change camera framing and angles to slip past the ESRB radar, leaving the offending content in the game, and changing the camera back with the patch. So they're trying to trick the ESRB into giving an AO game a M rating. As far as I know, if there is adult content on the disc at all, the ESRB needs to be aware of it. It could be considered a 'scam' in the sense that they're scamming the ESRB into letting them sell this on video game consoles and at Walmart.
