It can, but only with the joint determination of the SOS and the Secretary of the DHS. It's hard to get that when you don't inform people of the order before you sign it . And lest you think that only whiny liberals take issue with this, as is your deflection of choice, here are many Republican members of Congress who disagree with it. So the takeaway from this is twofold. First it is a bad policy, second it was badly implemented. Why bother defending it?
