It doesn't matter what the offense was, it's simply necessary for each element of a crime to be proved in order to have a criminal system function effectively. It sounds from the article like the prosecution failed to prove a specific element of the offense, probably the mes rea or rapist's intent. It doesn't matter what evidence actually exists if the prosecution does not properly present or argue it in a legally sufficient way. This is important across the board, because if the state can get away with hammering through cases that shock and offend us and in which the offender is clearly guilty without being technically accurate, that creates precedent for "lesser" crimes to be handled sloppily too.
I can assure you the appeals judges were horrified by what the rapist did too, but that doesn't mean it was a clean trial. A clean trial protects everyone, even victims and especially future people who are wrongfully accused. Seriously clam the fuck down, the guy will get convicted next time and it's not like he's going to enjoy having to go through a whole 'nother trial and being in custody till then.

I'm confused though because I thought people under the age of consent cannot legally consent to sex - at all - under any circumstances. So it wouldn't matter if he understood the boy was saying "no" (or "nein") because the boy was under the age of consent.

I work with 1000's of Mudlsimes. It's likely that there are just different particular things that need to be proved under Austria's code for sexual assault and for rape. The sexual assault charge was upheld and that probably required not much more than establishing there was sexual contact with a child under a certain age and/or that he said no and/or that force existed.
Higher degree crimes require more proof of the offender's state of mind--the difference, for instance, between premeditated murder and manslaughter. Same outcome (death) and perhaps same facts, but you need to show what the defendant thought and knew before you can convict them of the former because we do punish people more harshly when the offense involves a subjective understanding that you're about to do something wrong.
It'd be common in the U.S., for instance, for a prosecutor intending to convict for rape to need to prove a subjective understanding on the part of the offender that he did not have the victim's consent. That he heard "no" or that there was a clear case for sexual assault likely isn't enough. It could be as simple as the prosecutor, in closing argument, saying that given that he heard no and he used force, there was enough evidence to infer the offender's state of mind, or the judge giving a particular instruction that finding someone guilty of rape requires that finding. It's more of a procedural/technical requirement than a matter of what evidence actually existed, it's how it's presented and argued.
Again I'm just going from a race baiting and not terribly well written article, but I don't find the particular sequence of events unusual from a technical perspective, because judges and prosecutors and attorneys do miss this stuff sometimes.

-number of German criminals: 1.532.112 - number of Germans in Germany: 74 mil
-number of non-German criminals: 617.392 - number of non-Germans in Germany: 8 mil

And that's just scratching the surface when it comes to statistics, from 2015! 2016 was way worse, everyone who was on the borders on the Balkan route during 2016 will tell you the same thing. I'd be interested to see what comes out of that. I suspect a lot of this also relates to the conditions refugees end up in, isolated and poor in a foreign country where the native folks resent them. Clearly you can't just import tons of people from a foreign country with a totally different culture and expect no problems. It is very difficult. Luckily we'll just be building a wall here and not have to deal with more brown people. I expect rape and botched prosecutions to end entirely.

That's not entirely true. A lot of resentment was against the EU itself.
But yes, the main issue was immigration. And the Leave politicians managed to get people so scared and angry about immigrants that they narrowly convinced the voters to cripple their own economy, against all expert advice.

They were scared by the right-wing media's narrative on immigrants, which politicians like Nigel Farage further capitalised on. As Becky has highlighted throughout the thread, that narrative often doesn't stand up very well to scrutiny.
What I find worrying is that these big anti-immigration political forces, UKIP, Trump, the Front National, Wilders, all seem to be quite nutty and/or incompetent. They're either unashamedly subscribing to questionable policies and beliefs, or continually embarrassing themselves. Frankly, I'd much rather trust a more moderate party to manage the refugee situation, over those people.

But relative numbers are deceiving when the crime rate was low to begin with, and is still low and when put into proportion (nr. of germans/nr. of right wing crimes) is still a fraction compared to asylum seekers/crimes committed by asylum seekers.
