If there are specific things the prosecution has to prove, and they fail to do it, the verdict should of course be overturned. It doesn't matter what the offense was, it's simply necessary for each element of a crime to be proved in order to have a criminal system function effectively. I came 2 days ago from back from Berlin, second round of investments for one of my startups. We raised well over a million Euros, and I now employ a full office of Polish devs, designers and media/marketing people.
Like I said, I bring value to the communities I join. There are reasons why I don't do it in my homeland, reasons your brain can't comprehend.
I felt the collective madness those immigrants unleash on my own skin. I went to the Serbian border to volunteer so I can get as close to "the happening" as possible, and the shit I've seen, is far from what a normal refugee crisis looks like (like the one during the early 90s and the civil war that split apart Yugoslavia). And if you dig through social media like twitter and FB, you'll see people reporting the same shit all over Europe.

I'm confused though because I thought people under the age of consent cannot legally consent to sex - at all - under any circumstances. So it wouldn't matter if he understood the boy was saying "no" (or "nein") because the boy was under the age of consent.

Educated and most have more advanced degrees than I have - Otherwise they wood not qualify for H1B Visa's so they can be imported (most come directly after graduation from a US Super University or Oxford or other great Uni in Eu. Only a few come directly from country of origin.

It's likely that there are just different particular things that need to be proved under Austria's code for sexual assault and for rape. The sexual assault charge was upheld and that probably required not much more than establishing there was sexual contact with a child under a certain age and/or that he said no and/or that force existed.
