North Carolina.

Bill passed and signed by Gov. Pat McCrory. Georgia legislature passed a bill overturning every local LGBT anti-discrimination measure in the state and requiring that individuals use the restroom of the biological sex on their birth certificate. The bill was rushed through the House and Senate and subsequently signed by Gov. Pat McCrory, whose counterfeit reasoning was that the bill was “passed by a bipartisan majority to stop this breach of basic privacy and etiquette"

Adar v. Smith


Summary

After legally adopting their Louisiana-born child in the state of New York, Oren Adar and his partner Mickey Smith were told by the Louisiana state registrar that she would not issue a new birth certificate for their child, because Louisiana does not recognize adoption by unmarried parents. Lambda Legal filed suit on behalf of Adar and Smith in October 2007, saying that the registrar violated the Full Faith and Credit Clause of the U.S. Constitution by refusing to recognize the New York adoption decree, and that denying a birth certificate only to children of unmarried parents violates the Equal Protection Clause of the Fourteenth Amendment to the Constitution. The Louisiana attorney general had earlier advised the registrar that she did not have to honor an adoption from another state that Louisiana would not have granted under Louisiana law if the couple had lived and adopted there. In December 2008, a U.S. district judge ruled against the registrar, finding that the attorney general was wrong and that the registrar's conduct did not comply with her full faith and credit obligation. The court ordered her to issue a new birth certificate identifying both Oren Adar and Mickey Smith as the child's parents.

It's unlikely that adoption rights would be affected by statutes at a local level, but this is a response to Charlotte passing protections for LGB people for things like employment.

North Carolina and Georgia are both dominated by a large progressive city, but outside of those two cities or university towns it is very rural and very poor. There's always going to be tension between Atlanta and Charlotte and the state legislatures about things like this.

The men, Oren Adar and Mickey Ray Smith, argue that gay couples have a due process right to be listed on such certificates as joint custodial parents. A federal appeals court has ruled against the couple.

That's not what I was referring to. What I meant was that the state had exempted those with birth certificate changes, even those who could get it changed without the operation. So this bill has guaranteed the right to use the bathroom and locker room for trans people who have gone through the process completely.

A letter from the requestor stating the following information, as listed on the current birth certificate: name, date of birth, place of birth, names of parents, and contact information, and

A certified copy of a court order that states the person's name, date of birth, gender currently listed on birth record, and new gender, or
A letter from the person's physician stating that the person has received the appropriate clinical treatment and the person's new gender.
