Appeals are mandatory in a death sentence, right?

What if an inmate represented himself but then simply refused to file the appeal forms or do anything? Would they be forced to let him live?

They'll just have the appeal without him I guess.

@OP
ACLU or some other do gooder group will fight tooth and nail to prevent State from executing those guilty as charged.
Inmates do not have the right to stop do gooders.

How can they have an appeal without a defence!?

They can have one without the defendant present. Not without a defense. You can't just refuse because you don't like the consequences if you lose.

Every guilty man in history has tried to get out of going to trial. Avoiding a trial is part of not being caught though.

So they can't have a trial without a defence?

Without a defense it isn't a trial, but fucking yourself over by not having a defense isn't going to stop bad things happening. The guy is in jail already, if he fucks up even slightly they'll throw him back in a cell and continue on without him. I hope he briefed his court appointed shit tier lawyer well, idk. The judge would probably just be pleased it's a really short appeal and award it to the prosecution because the "Waaahhhhh, :( I don't wana!" defense didn't hold up too well against actual evidence.

Just because the killer is the only eye witness of the killing and refusing to speak about it, doesn't really mean much to the prosecution and their mountains of evidence. He's still up against all of the same evidence that got him convicted. That's pretty much how these things go, probably with more blood and semen though, don't you watch CSI? Has television taught you nothing!?

So the court has the authority to fire your lawyer and replace them with your own?

Anonymous B replied with this 10 years ago, 5 minutes later, 1 week after the original post[^] [v] #640,226

@previous (A)
They can likely stop you from representing yourself, if you then don't represent yourself in court or even file the required paperwork. Yes, I think if you fuck about like that and they want to help you they'll give you another chance, and a lawyer. Or you just lose the appeal because you fucked it up.

@previous (B)

So they can fire your lawyer and dismiss the appeal without actually doing one?

Anonymous B replied with this 10 years ago, 41 minutes later, 1 week after the original post[^] [v] #640,256

@previous (A)
Representing yourself, and then just not doing it, is the same as having a really, really shitty lawyer. They'll still have the appeal, you'll just lose it quite quickly and the process will continue until you are dead.

This loop hole you have found for death row convicted killers to rot in jail until they die won't hold up. Even if it did stall things, they'd just change the law making it more humanitarian, so you can't fuck about and ruin your only chance of saving your own life by trying to avoid the appeals process.

I bet they have those guys on suicide watch, so they can kill them properly for their crimes. You make it seem like these guys would rather do 50+ years in a cage with all the other killers and then die of old age, anyway.

@previous (B)

How can they do an appeal if you do not fill out the proper paperwork? They just do it for you, thus denying you the opportunity and thus your constitutional right to due process? What's next, secret courts?

Anonymous B replied with this 10 years ago, 15 minutes later, 1 week after the original post[^] [v] #640,394

@previous (A)
Secret courts are only for wealthy powerful families
