If you are not a rapist (we'll narrow it down to one thing to make it less confusing) and you are having a discussion about someone who is a rapist, then yes, you may take the moral high ground. You ARE allowed to say that he is a bad person in the instance of rape. Otherwise you'd have to find an argument to defend rape --and i'm sure there are arguments to defend it, but my point is that it is morally wrong and it is perfectly fine to use that as a justification for judging people.
However, Nancy Grace takes it too far because she is in the business of sensational media. This makes her a corporate shill, and a sell-out as well as being a grubbing harpy. But she does have the moral high ground.
