I had once to size down my team... I didn't have to tell "you're fired" but I had to tell "you're off the team" and then company boss fired him, lol.

Just go straight for it, no dancing around no cheasy lines... you're all professionals, shit happens.

> Their work has gotten very sloppy/bad and unreliable. Not improving with talking to them and making suggestions etc.

Its simple enough. Just repeat Exactly wot you just rote and repeat. Then say I have to let you go.
If you get any flack then just say. If I do not discharge you then I will lose my job for incompetency.

And It never feels good to fire anyone. Comes with the position.

Yes, I had to lay off some casual staff from the production company I work for. They took it well except this ginger bitch who tried (and failed) to arrange a casual staff strike in protest.

don't do any of this, never tell them not firing them makes you incompetent.
just explain the facts of the situation. Bring him into your office and rip off the band-aid. give them an exit strategy, too. This is how it's going to work, when you leave, how you'll be paid remaining pay, etc., thank them for their work and tell them they'll have a reference going forward. It wouldn't hurt to have an outgoing package as well, detailing how to receive final pay (if there's anything weird about it) and it wouldn't hurt to go ahead and provide a few copies of a prewritten reference that highlights the person's strengths and explains their responsibilities.

they are going to be pissed, i would recommend you try and do all the talking and don't give them much opportunity to object, argue, or beg.

just be matter of fact, and be prepared. be nice, be understanding, but don't be apologetic or wishy-washy. don't bother explaining yourself either, just say, "your position is being made no longer available, and we're going to have to let you go. [blank] will be your last day, and here is a packet explaining how to receive final pay as well as references going forward. thank you for all the hard work that you're put in over the [years/month], and good luck to you going forward."

or something like that. just be direct, don't dance around, rip the band-aid off, have resources for them to lean on,
and be as nice, but as firm as you can. don't hurt his feelings, but, know that being fired is going to hurt regardless.
i'm surprised you don't have anyone at your place of work that can train you in this kinda stuff. actually kinda surprised you're having to do it yourself. i don't know how big a place you work for, but if you've got an HR dept or something like that then they'll probably have some advice for you. or, like, written guidelines or whatnot.

just don't do anything that'll get you sued. you're a lawyer, you should be fine.

I actually only once had to use that line. I had to fire a co-owner of a company. I did not consult with the other two owners who on the Org chart I reported2
The owner that reported to me was shiftless n lazy and not getting work assigned. So after several warnings I fired him. He said you cannot cause I own the company. I said I had to cause otherwise I wood be fired for my incompetency. It all ended up painless but for a few days Yes I wondered but the other owners never even made mention of it in any meetings.

> your position is being made no longer available, and we're going to have to let you go.

That is NOT honest IF the position is filled immediately. You never really want to lie to the person you are discharging

"the company has decided to go a different way and we're going to be letting you go. "

i think that's basically verbatim what one of the articles i linked to said. i have no idea how to make what becky needs to say generic. but generic is the way to go. but yeah, lying i guess isn't good. but also attempting to justify yourself TO them is not a good idea, no need to argue or throw every little misdeed in their face. no need to shame, just explain what is GOING to happen.

idk, i've never really had to fire anyone because they have fucked up, i've told contractors their services won't be required anymore and that can be tough when you're dealing with people who've been working with you for a long time. but, that IS different, because you can generally go back to contractors and hire them again with no hard feelings. i've also had to terminate part-time employees, but, there again they were hired knowing they were basically temps. so. firing someone for being a bad employee is not something i've ever had to do.

I have had to discharge about 20 over the years. Had to lay off a LOT more re downsizing or merging. Having to decide who stays and who goes is one of the most horrid parts of being a manager - at least it sure was for me.

What do they do? Like is it a secretary or paralegal or the janitor?

As for advice, watch a few episodes of The Apprentice. Sit at the boardroom flanked by two trusted lieutenants and call the team in. Then have them debate about why things got fucked up then say you're fired to the employee in question.
