Arkansas' Supreme Court has gone against an initiative approved by 57 percent of voters and has opened the door for homosexuals to adopt and provide foster care for children. (See earlier story)
The Arkansas Supreme Court on Thursday rejected the initiative that barred same-sex couples and other unmarried people living together from serving as adoptive or foster parents. Jerry Cox, president of the Family Council Action Committee in Little Rock, believes it is the worst decision ever rendered by the state's highest court because in the past, the state has put the best interests of children first.

He goes on to describe the ruling as "judicial tyranny," and he believes that is the view of many people on both sides of the issue. Even so, "the court simply ignored the will of the people...took matters into their own hands and looked at the people and said, 'What you think doesn't matter; we're going to have the final word in this.' And they took control of the issue and struck down a good law that's there for the welfare of children," the Action Committee president laments.
Cox is still unsure about what his group will do next, but he says the Family Council Action Committee will consider pursuing a constitutional amendment. However, he says voters may very well decide to boot from office the court's justices, who face re-election every eight years.

They did the right thing. We are not a pure democracy, we are a democratic republic where certain rights are guaranteed in order to protect some minorities from tyranny of the majority. The majority can't just make the law whatever they want. In this case, the courts saw that the law would be discriminatory and basically ruled it unconstitutional. The system works, in this case.
