No, that's not what happened. The lawsuit was twice dismissed because it failed to meet pleading requirements for a medical malpractice action. This doesn't get to the merits of the case; it's just an initial hurdle plaintiffs have to get over because the medical lobby has been successful in enacting unconstitutional laws across the country that make it harder to sue for medical negligence as opposed to regular negligence. You just have to be really specific about exactly what went wrong (which can be hard to do when medical records are unclear, scrubbed, or you were unconscious when the malpractice occurred).
It can be re-filed again and almost certainly will be. To me it just sounds like the plaintiff's attorney is inexperienced in how you need to plead this kind of case.
