So a few weeks ago I made a topic about a girl I was seeing broke up with me and became a stripper. Well, I just found out she's going on 14 weeks pregnant. I may or may not be the father. Having a kid doesn't even freak me out. What freaks me out is she's crazy and is talking about running off to South Dakota to start fresh and get away from everything, and I have to be the one to file a paternity suit just to keep her from running off with what could be my kid.
A lot of guys would be relieved that she's running off and not demanding support but that's not the type of guy I am. I want to take responsibility and be a part of the child's life if it's mine, but she's being as difficult as possible.

Actually, you can, at least in Delaware. By "run off" of course I don't mean that they treat leaving the state like it's breaking parole, it just means that she would be ordered by the court to submit to a paternity test and if she were hiding in South Dakota she would be held in contempt of court. Also, if the court decided that there should be joint custody, then she would be required to bring the kid back. I am hoping that she'll be reasonable and voluntarily do the test and if it's mine, allow me to help her and the child and be a part of its life, but since she's already talking about moving away I may have to take legal action if I want to be a part of my child's life. Delaware is not a "mom first" state. Both parents have equal rights.

Not really. I might be committing political suicide by saying this, and be accused of selling out, but here it goes: I want to get away from the baby daddy altogether. I want to get away from the idea of being a mom altogether. I want to create a babby that is more like a fashion accessory than anything else. It would be like a little dog, with the focus being on the clothes and real cuteness rather than it focusing on food, poop, nap-nap, peekaboo, milk, etc. It would give you the option to go party rather than forcing you to "look after its welfare", but waiting and holding off on the shots for 10 more minutes would be an option.

In Delaware, if a parent doesn't show up to the family court he/she is held in contempt of court, and they basically treat it like a kidnapping. Doesn't matter if it's the mother or father. I know a guy who's ex-wife wanted to move just to Jersey, but the judge said "nope, it's your responsibility to get the kids to him when he has custody." I know another guy whose ex-wife tried to run off to Texas with the kid, now he has full custody of the kid and she has to pay him child support because of the stunts she pulled.

In Delaware, if paternity is established, it would be no different than if we were divorced. She would have to be living in South Dakota for at least 6 months before I file suit for them to say she doesn't have to come back. The only way she could move to South Dakota would be to give full custody to me.

Source? I mean it's possible (states differ), but I have never seen a family law be so explicit where you could say for sure how custody decisions would come out ahead of time. It's normally something like "the court may make decisions based on the best interests of child, considering the following factors," one of which would be the relationship the father had with the child before the mother tried to move.
If you want a say in the kid's life, you pretty much have to marry her, or establish a relationship with the kid first somehow. If someone has to move, it's probably you. You don't get possession over people when you fuck them. This is why people get married!!

I am getting this info from friends and Delaware lawyers. Delaware protects father's just as much as mothers when it comes to parental rights. The reason the law in Delaware is set up this specifically is so that women can't run of to prevent fathers from building a relationship with their child. Do you really hate men that much that the thought of us having equal parental rights disgusts you?
In Delaware, custody is usually mediated through the courts to figure out what's in the best interest of the child but the only time they will say one parent had no right to custody is of they're deemed an unfit parent.
If she told me I had to move to South Dakota and marry her to be a part of the child's life, and take her up on the offer, but at least in Delaware, she doesn't have the option to be completely uncooperative to keep me out of his life.

You have no basis to file anything telling a woman she can't move to another state. That's your problem here: you're not a parent and you have no parental rights, because there is no fucking baby, and there's no presumption of paternity because you didn't marry her.
Do you think I could demand an order that an ex of mine can't leave the state? Legally, that example is exactly the same as the one you're in, because you have no legal rights over another woman's fetus, and you have no power to compel her to do anything. If you care about making babies with someone, you marry them so you get paternity at birth, and then you have some rights to the child.

This much I Have learned about the Law the hard way- Attorneys are similar to Engineers. Issues are complex and Attorneys end up specialized just like Engineers.
If you go to an office with a case - You could end up educating an Attorney who will learn the ins n outs of the law and charge you for that education but of course not tell you they are not experts cause well they want money from your wallet.
I will share a more direct better example that is close to home.
Back when I needed a divorce attorney years ago I found an office that had one very good family law set of attorneys and far more business case attorneys. That means there were CPAs and Tax law experts.
Now my Ex chose a rather Infamous Gloria Allred. Actually in my opinion she not so much so good because she ends up far to invested emotionally in each case but that is my opinion.
Her office did not have at the tyme anyone with any background in business issues and most important was anyone with any IRS background or even a CPA
So I ended up with my attorneys taking advantage of what the other side failed to have in expertise.
Since that tyme I use Attorneys mostly for real estate issues and the very best I found have reputations that are easy to check out. WoW what a difference it makes to get an attorney that will look at my case and show me examples of cases they won that were 99% similar. And the side benefits of them knowing the best fix it people to employ - Painters electricians contractors - all that for free because they knew who got sued and who didn't -

Exactly. It's a problem of jurisdiction -- which is the power of a state's court to make and enforce orders. "Rights" to a child are very different from a court's jurisdiction over the parties.
Broseph is getting hung up on the "same rights as married couple" things, but there are big differences between the two scenarios.
- A married couple is (usually) living together, in one state.
- The child is conceived and born in that one state.
- The father usually has a chance to establish a relationship with the child before any custody disputes arise. Courts care a lot about maintaining stability for the child: it's easier to "continue" custody than fight for custody you never had, once the child is in another state.
- The custody dispute is dealt with as part of a larger case, one in which both parties consent to the state's jurisdiction over them.
It's true that Broseph can file a paternity action now, but it's going to be pointless if his ex wants to dodge the court. DE cannot order testing of the child in utero - she has to agree to it. See Uniform Parentage Act Sec. 8-502(c). (While it's called "uniform," it's not a law South Dakota has adopted; a few other states have, though.)
Let's assume ex has already fled to South Dakota. (She would be wise to leave now before anything is filed, if you're talking crazy about forcing her back to DE.) Delaware loses jurisdiction over her the instant she leaves the state because she is simply a woman traveling by herself and states can't restrict interstate travel. Having sex in Delaware does not obligate a person to stay or return to that state. (It apparently does confer jurisdiction on SD courts if the sex occurs in SD, though: see here for each state's "long arm statute.")
So, the baby is born in SD. SD courts gain jurisdiction over the child upon birth and over the mother because she's a resident. Now Broseph can file in SD, get a genetic test and a declaration of his paternity, but she can make life super difficult if she doesn't consent to Delaware's jurisdiction. He will have to attend court in SD (may be possible to Skype but it won't look good), have interviews with social workers there, let them determine who's the fitter and better parent, because the parties have forced a decision about where the child goes. If he doesn't have a job or a residence there, he doesn't look good in that analysis. He has no history/relationship with the child to point to.
You cannot turn this into an acrimonious thing, Broseph - either cut bait or decide you are all-in, which means working with her. She can agree to any custody arrangement that isn't blatantly crazy, and the courts will accept it. If she wants to go to SD, you basically either have to join her or accept being an absentee father. She can and will get a child support order against you, too.

It is different:
The mother doesn't determine where the father stays - the courts do. They make custody determinations based on the best interests of the child. Most courts will have a standard order they follow if the parties cannot agree. In the court I'm familiar with, that would be every other weekend and one night a week. There's a legal difference between child support and custody/visitation. Child support is considered a right belonging to the child, and is analyzed differently from decisions on visitation (which is considered a right of the parent). She can seek money from you after the child is born in SD. She can get a child support order against you and Delaware will recognize and enforce that order, without your gaining any visitation rights. You can seek visitation/custody from that SD court, but you will have to play by their rules.

Some words of advise I got from an Ex-GF that was a head shrink
Make sure you rehearse what you will say under pressure and do it over and over - If you hit any hot buttons then you end up cutting off further communication and it can be costly and make you fail.
Let her do 90% of the talking and be a good listener. This may be your only opportunity to set the stage for a better long term relationship which means cooperation at the minimum.

Thank you for sharing that link. It does make me feel a little better about the situation. It's good to know that South Dakota is becoming more like Delaware with equal parenting rights. It would suck if I have to go to South Dakota to fight for all this shit, but I'd rather try to start in new life in South Dakota if I have to to be part of the kid's life than have to pay child support for a kid that I barely, or never get to see. So, an update. The other guy reached out to me on Facebook and he's being very friendly about the whole situation. She's calmed down a bit and isn't talking about going to South Dakota anymore. Everyone is on board to get a non-invasive prenatal paternity test done. There's not much of a point though, because unless the ultrasound is off by about 2 weeks there's no chance he's the father. The test is more to just prove it to her than anything. She was never going to tell me, until he saw the first ultrasound result, did the math, and flipped out on her for lying about it the whole time.
She's still working at the club, but stopped stripping and works there as a DJ now. I'm still a little salty about the whole situation, because she's still not giving much thought to giving me another chance so the kid can grow up with both parents. I told her I'm not trying to get her into a relationship she doesn't want to be in, but I want the kid to have a chance to have both parents and I want the chance to be a good father. It's not like things ended on bad terms. We never fought or anything so I just don't get why she's not even willing to give it chance. She has this idea stuck in her head that even if it's mine she wants to stay with him and have him be like a step dad, which is why I'm salty. The kid's not even born yet and she's already got a step dad picked out, which isn't giving me much of a chance to be a father. She actually suggested that I move in with them and pay rent, like I'm supposed to be OK with living with the guy fucking the mother of my child. I don't think he's going to want to stay with her if the tests prove it's mine though, but I'm worried that when this fantasy of hers comes tumbling down she'll freak out and start thinking of going to South Dakota again. The other guy is an outstanding gentleman and has really gone to bat for me, and keeps telling her she should give me a chance if I'm the father.
All I can do now is hope that things will work out. If she's not willing to give the idea of trying to start a family chance, then all I can do is file for custody when the baby is born.

She sounds young. She's living in fantasy land.
She has to face some realities here: this other guy is totally free to run away from her and abandon the kid, up until an adoption, which you can challenge. He is never going to care about the kid the way you do, he will never pay for the little things you are willing to, he just doesn't have the buy-in.
The idea of moving you into their place reminds a lot of the kind of girl who will cheat on her SO and cuckhold him and all sorts of other foggy-thinking -- you have to see women breaking up their families for affairs to start to recognize that particular brand of crazy and where it can lead. I think you need to be really, really careful with her. Document every important conversation and every cent you give her; keep the facebook messages; etc.
But I think her mindset might change when she recognizes the vulnerability of her position. She will get big, no firm job, the guy might leave; the economic realities will hit her at some point. Does she have family in South Dakota -- what's the draw there?

These were my thoughts exactly. You and I are on the same page. I have saved all the text messages. Like I said, I'm hoping once we do the test reality will start to set in and she might snap out of fantasy land. As far as the possibility of cheating, cuckolding, and not being able to trust her in general, I realized that as soon as the reality hit me that if the other guy had never caught on she might have never told me.
Oh, and the South Dakota thing. She has family in South Dakota, but she has family here, too. It's her dad's side of the family in South Dakota, but she told me that her dad wants nothing to do with her, so I have no idea what her reasoning was other than just wanting to run away from everything.

Well the DDC (the company that does the DNA tests) fucked up. They drew blood on the 11th and we were supposed to have results in 5 to 7 business days. It's now the 25th and they're saying they need to redo the test and we should get the results next week. Really pisses me off because the DDC has the best reputation and is the most expensive. We paid extra to get fast and accurate results. $1945 it cost, and we're still waiting.
On the bright side, I found out it's a girl.
