However, consider that Matt has been a functioning alcoholic and Internet troll for decades. Green's star burns far too brightly to last; he has no staying power. We can't rely on him. For the stability of the fora, we need at least one drunken mess on here at all times, and Green's legal troubles could threaten the entire fora if we don't adapt. Thanks. Thanks.

If you any evidence of this, I invite you to post legal proof RIGHT HERE, RIGHT NOW. Thanks.

Until then, let's compare the facts:

MAtt:
Has a postgraduate degree.
Has traveled the world.
Cultured, well-read, erudite bon vivant.
Professionally trained French chef
Fluent in many languages
Two decades of fora trolling experience
Honored by the ICIT as the world's third-greatest troll

Green:
Has half of a high school education
Has traveled to Tesco
Can barely write in English, let alone Chinese or French
Can't even roast a fedora properly without setting off the smoke alarm
Two years of fora trolling experience

Looks like Indy wins again!

The Lord Chief Justice listed the factors that were relevant when considering an application for adjournment:

· A decision whether to adjourn is a decision within the discretion of the trial court. An appellate court will interfere only if very clear grounds for doing so are shown;

· Magistrates should pay great attention to the need for expedition in the prosecution of criminal proceedings;

· Where an adjournment is sought by the prosecution, magistrates must consider both the interest of the defendant in getting the matter dealt with, and the interest of the public that criminal charges should be adjudicated upon, and the guilty convicted as well as the innocent acquitted. With a more serious charge the public interest in there being a trial will carry greater weight. The Lord Chief Justice commented that the courts in England and Wales have addressed applications by the prosecution in a robust fashion because of a perceived need to deal with a culture of adjournment. He added that the courts in NI have not reached the point where such action is either necessary or appropriate;

· Where an adjournment is sought by the accused, the magistrate must consider whether, if it is not granted, he will be able fully to present his defence and, if he will not be able to do so, the degree to which his ability to do so is compromised;

· In considering the competing interests of the parties the magistrate should examine the likely consequences of the proposed adjournment, in particular, its likely length and the need to decide the facts while recollections are fresh;

· The reason that the adjournment is required should be examined and, if it arises through the fault of the party asking for the adjournment, weighted in accordance with the gravity of the fault. If the party seeking the adjournment was not at fault that may favour an adjournment. Likewise, if the party opposing the adjournment has been at fault, that will favour an adjournment;

· The magistrate should take appropriate account of the history of the case, and whether there have been earlier adjournments and at whose request and why. A case listed on the first occasion should proceed unless the court is persuaded by other relevant factors that it should be adjourned; and

· The magistrate should consider the interests of the victim and the desirability of having prosecutions determined on their merits rather than pressing ahead in the absence of witnesses.
