No, but not telling someone you have HIV won't invalidate consent. That doesn't mean it's OK to do so, of course, and people have been charged with GBH for infecting partners with HIV.

It makes a little more sense that it's still illegal to not tell a partner you have HIV. I guess I'm just not understanding the justification behind saying that gender invalidates consent while other important factors do not. It seems a little like they're just picking and choosing randomly.

I disagree with the ruling. Once you begin having consensual sex with someone, then you have accepted them as suitable and you accept all liabilities resulting from the sexual act.
Like if a man has sex with a woman who tells him she is on the pill, and it turns out nine months later that she lied, the man has no legal recourse and will still have to pay child support.

I'll respond with another analogy. Let's say there's a man who lost all his genitals in a horrible skiing accident. He still sees himself as a man even though he doesn't have the parts. He gets a girlfriend. The girlfriend is under the impression that he has a penis. They have oral sex. Is that a criminal offense? I wouldn't see it as such.

In that case the Guy is a Male who is missing a part he was born with. Not pretending to be anything but a Male - He should inform his partner that PART of Him in Missing and WHY
I think the major difference which in my view is criminal - A straight guy does not want to end up kissing a Guy - Same for a straight girl who wants to kiss a guy but could be deceived.
Even a full total Docs Sex change does NOT change the DNA. So full disclosure is still required.
