Okay so here is the story (cannot release agency name yet),
I'm Driving down a large interstate (on Dec 31 2010) when i expressed my first amendment right and flipped off a state trooper out my window. While he speeds up 80+ mph behind me (as defined in the video), i slow down and pull over. He claimed that i used "excessive brakes" and it was reckless driving. Long story short he came to the car, asked me to turn it off and stated "what is your problem, why did you flip me off". I stated "because this is America". he quickly arrested me and shipped me off to jail with an M4 "making an obscene or offensive gesture", an M5 reckless driving, and speeding.
After i bonded out, i knew i had the right to flip off an officer. I told him this, but it still landed me in jail. I did more research and found several cases where people have sued police agency's over this false arrest. Usually people are ticketed for the offense and not charged with an M4. The law states that you have a right to express the finger one time to any person (except courts, etc). This officer clearly was emotionally driven, which will in turn be his downfall.
I contacted the ACLU a few days after my arrest and they gave me the general welcome ACLU letter. About two months later i got a reply stating they were inquiring "more information" about my case. They listed several questions which i forwarded back to them. Hopefully just hopefully the ACLU will represent me.
I have my criminal case in the next few days, and my lawyer stated that everything should be settled except the speeding. He actually hopes the judge rules against me so we can move this into higher courts and have a better chance at the civil case. My lawyer is also providing many case law examples for my behalf.
Thankfully this whole incident was recorded on the dash cam. In the film, You can CLEARLY see i violated no laws except speeding. As charlie sheen said, this should be a case of WINNING!!!!!!!!
