Diesel cars pass emissions in most states. If I recall correctly, the main hangup with importing Euro diesel cars is 1) pointless safety regulations (like headlight and bumper requirements), and 2) no one in this country really wants diesel cars. They were popular in the early 80s during a fuel crisis and then people realized they're slow, they stink, they're noisy, and they're expensive. I know modern diesels are as fast and quiet as gasoline and they don't clatter and belch black smoke anymore but that's the image people have. The TDI Golf costs nearly $5,000 more than a gasoline one and for what? 8mpg more? But on fuel that's 10%+ more expensive than gasoline? Is it really worth it to save money on sparkplugs?

Because emissions are not based on mpg, and because they still do not consider carbon dioxide an "emission". It's based more on how much carbon monoxide, and nitrogen compounds, and sulfur compounds are emitted. Diesels often do not pass because although they are often more efficient, they do not burn as cleanly as gasoline engines and produce more of the emissions they are looking for. Modern diesel engines are much cleaner, however, which is why you see more and more diesel cars these days. The cleaner diesel technology allows more of them to pass the emissions tests.
