Topic: Do you think it's right to put transgendered criminals into prisons according to their true gender?

Anonymous A started this discussion 14 years ago #21,832

I mean anatomically speaking. I would imagine there are some laws that change the outcome depending on hormone treatments they have been taking, for how long, etc. I was wondering about this the other day.

If it has a dick, then it can rape genuine women.

most should probably be kept privately, or with other trans people.

I heard somewhere that MTFs who are put in male prisons are at higher risk for gangrape and violence by fellow in-mates. I don't know the exact numbers so I could be wrong.

How often does that actually happen?

Maybe the guards could just like stop prison rapes, you know? It seems like they don't even care.

I don't think it has ever happened. they're always put in solitary.

Maybe the rapists, could like stop raping people?

Obviously, but given that these people have been put in this place for their lack of respect for the rights of others I find that unlikely to occur.

I found an article where it happened in Philedelphia involving a case of a transgendered person (MTF) who was put into a women's prison and was forced to perform oral sex on a corrections officer. The argument in this scenario that most will say is "why was this person wrongly put into a women's prison in the first place?" but I mean it has happened. In the case of Anonymous D's post it does show that even guards/corrections staff are capable of abusing the system in the same fashion.

No, we're talking about ftm, and that never happens to them. Wait, oral sex on a female officer? That;s interesting.

They really should be kept alone.

I don't understand this post at all, but feel free to read the article... Oh wait, I posted the wrong one earlier. My apologies. This is what I was actually referring to http://www.philedelphiacriminallawnews.com/2011/09/transgender-sexual-abuse-claim-sheds-light-on-jail-problem.html Sorry.

Its like they considered him to be a non violent offender, and felt like he would be raped by male inmates. He still abused by a male officer, so that didnt work.

That being said, what's the solution there then? I mean, it is the law in most places to correctly assign people to the gender prison they belong to, but is it a correct law or does it need to be changed?

Also, curious that you say they should be kept alone. Do you mean that there should be separate prisons for MTFs and FTMs?

Anonymous C replied with this 14 years ago, 19 minutes later, 1 hour after the original post[^] [v] #345,661

I do think that those people should be kept together with female guards only.

I often wonder about capacity of most modern prisons and being able to segregate in-mates in such a way. Are they capable of isolation given how many are incarcerated or what? To me it seems more like a logistics problem on both accounts. Are there enough female guards for such a task? Is that practical? Could it be deemed sexist? There are a lot of questions needing to be answered for the sake of practicality.

If with dick then they belong in male lockup. If full conversion then put them in women's lockup.

Anonymous C replied with this 14 years ago, 4 minutes later, 2 hours after the original post[^] [v] #345,671

@345,669 (A)
I don;t think that most prisons could or would do this. Most are kept in isolation though. Having trans man in general population usually causes fights among the inmates, and horrible abuse for which the prison could be censured, or sued.

We don't have enough female police officers for this to work. It is sexist lol. So it will never happen.

Well there is the question that I am speaking of. Pre-op MTFs might have been many months under hormonal treatments to the point of having a more feminine voice, grown breasts, etc but have yet to undergo gender reassignment surgery so how do we classify them? Are they likely to rape someone else in prison or does it actually make them prime targets from other in-mates? That's what I'm also curious about.

i dont understand your question op

when you say 'true gender anatomically speaking', do you mean sex? gender is not the same as sex

The gender they were born with.

I don't think you actually know anything about gender identities

So why do you have an opinion on them
