I replaced my stolen iPod with same type of iPod; a 4th gen nano.
When I got it though, the play/pause wasn't working. He said all sales are final in the description, but that the item was in "good condition". But nothing about that one issue.
When items are in "good condition" I expect them to fully work. I've been buying on ebay since I was a kid (literally) and people mention these things.
So I dropped him a line:
"So I got it and synced it up, and even though it didn't sync any of my playlists, I figured that was okay and I was doing something wrong even though that was a little odd.
BUT I also noticed the play/pause portion of the scroll wheel is completely dead. I reinitialized the unit three times and it still refuses to work. I had a 4th gen nano for 2 years until it was stolen recently, so I know this one isn't working properly.
So basically, this little guy is broken. But all sales are final right? I'd hate to leave negative feedback, cause I never do that."
his response was this:
"sorry for the inconvenience.I purchased this iPod used and not new.The syncing worked for me everytime.On the play button it worked for me all the time but I noticed that sometimes it wasn't working when I clicked it directly but when you press to the little left of it it should work .this ones a 16gb and at a brand new price it costs $190.I'm selling it for less than half because its used.You are right all sales are final and no returns.If you would put no feed back rather than negative feedback that would be greatly appreciated.Thank you for your understanding."

Tell him he misrepresented the device as being in "good condition". Broken is NOT "good condition". Inform him that if he doesn't give you a refund, you will be forced to file a complaint and leave negative feedback. If he fails to give you a refund, follow through with complaint and feedback. Negative feedback is a GOOD thing for buyers, nobody wants to go through this shit.
If he is a half-serious seller he will comply. If he is not, he deserves the negative feedback and complaint.

Should have bought new you cheap fuckhead. File a Paypal claim and return that broken shit. As long as you paid via Paypal and you think he had false advertising there is no such thing as "no returns policy", they will send your money back if he doesn't. Oh you can also leave negative feedback then say you'll only remove it if he send you $10 as a "good will gesture", I've done that many times (after he pays don't remove it).

This exactly. I left like 25 negative feedback for one dude who was selling stickers that I bought. A week later I asked where the stickers were. His response was that they were pictures of the stickers. The ones that were on the actual auction. Nowhere did it state that, and why would I bid on a picture of a sticker? Fuck that guy.

I opened a case. He refuses to give me a full refund and started even implying I swapped out my old ipod (which i fucking told him was stolen) with this new one.

Yeah. Any further proof you can document will strengthen your story. Such as any images he provided of the device, serial numbers, etc, your receipt, you photographing/making video proof of the device not working... but that's just a guess.

Almost have a couple times or so. If you ever saw that iPhone 4 I had, there were two times it almost sold for $800. Bought with stolen accounts, so luckily I wait a week for the payment to clear. Especially when it's a big payment like that, I suggest everyone do that with large amounts coming in though.

Exactly. I ended up getting $750 for it eventually, but it was a pain in the ass to keep listing multiple times. Especially when the claim took like a week to actually complete.

In a way. I mean, it was pure profit, but if those first accounts weren't stolen it would have been $800. Also, it sucks now because eBay fees and PayPal fees. Fuckin' eBay owns PayPal.
