'Consent' is not an issue in this poll. Just the fact that intercourse took place is what matters. The person being charged is over 18. I want to gauge the general feeling of people on this board.

I will say as a first offence in my opinion does not constitute life in prison, and it sure as hell does not constitute the death penalty. Some criminals can be rehabilitated, if given the right treatment, over the course of many years. It also depends on the circumstance. Was it a bona fide "Romeo and Juliet scenario"? Was the "rape" consensual between both parties? Was the "victim" forced or coerced under the threat of violence into these acts? Were drugs or alcohol involved? Has the "rapist" committed this act before, or is it a first offence? Does the "rapist" have any other drug offences or violent offences on his or her record? I am not justifying any sexual acts between an adult and a child, I personally find it abhorring, however, I believe the punishment should reflect the severity of the crime and the circumstances around the crime.

I think each case should be considered on it's own and there should not be a general punishment. If the sex is consensual and the minor is judged to be fit to decide whether or not he/she can choose to take part in the act, then no punishment should be given but the relationship should be watched and kept under control.
If it is genuine rape, then jail time should be given along with mental care to both victim and criminal. Say 20 years jail time and a lifetime of constant check ups and control for the perpatrator.

Ok, well-made points, but I don't know...I just have a problem with the idea of a child under 12 'consenting' to a sexual relationship. I accept that it's probably because of the time, place and culture I was raised in, and I don't say I'm right. I just can't get my head around someone whose body has not yet even begun puberty being psychologically prepared for a sexual relationship. But again, it may just be the environment into which I was raised.

I also find it hard to believe that if anyone (even those who say that an 11 year old can consent) had an 11 year old daughter who 'fell in love' with a 40-year-old guy, and wanted him sexually, then the father of that daughter would allow it to happen, albeit keeping a "close eye" on the relationship. It just seems to go against human nature, on a very primitive level, to have sex with under-developed children. Is there, for example, anyone here on this board who would feel ok about their pre-pusecent child having a sexual relationship with a man 20 or 30 years their senior, even if the child 'wanted' it?

Kids often want to try smoking and drinking, and maybe even soft drugs. Almost nobody has a problem with adults being punished for allowing them to do so. I just don't see why sex is any different, when in fact (only in my opinion) it is far more serious than those things.

Good points, let me clraify my opinion. It is my belief that when a child hits puberty (starts period/can ejaculate) that they are biologically ready for sex. Mentally, well obviously that depends on the child and his/her upbringing. Children are capable of coping with extrodinary things psychologically and sex is nothing compared to say living on the streets, or being bullied.

As for the parents. Well, although I wouldn't be extremley happy for my own hypothetical daughter to be in love with a 40 year old man, I would respect that it was her decision. But that would be down to me as a parent to decide. I'm underage, as is my girlfriend. Her parents are hardcore christians and I've been 'banned' from seeing her as they believe I'm a bad influece. That is their decision as parents. So I guess the point I'm trying to make is, obvioulsy the minor would have to take into account their parents wishes, but that is nothing to do with the state. To me it's exactly like the education of children on matters like drugs, abortion or safe sex. IMO, it should be down to the parents and not the state to get involved in affairs like that, so it is unimportant when talking about the law.

Again, I don't believe the adult should be punished for letting a child try smoking, drinking or weed. Forcing them to do so? Of course the responsible adult should be punished, but for letting them or making sure they do it in a safe enviroment etc? No.

Speaking from the US perspective...

Criminal records are already public. The sex offender registry simply makes it easier to find in one place, instead of having to search individual counties' websites for records, or having access to a legal database. The information is already there.

I think some crimes are so offensive to public morality, and represent such a danger to the community, that greater warning and publicity of the offense is justified. As long as the 'shaming' element isn't the primary motivation, I don't see the problem with it. We've already made the decision that people's criminal records should be known, and already use the incentive of sealing/expunging/etc. to encourage those who commit various crimes to plead down, or cooperate with probation, etc.

I think it goes too far though, some relatively minor offenses can land one on the registry depending on where you live. The problem, though, is that prosecutors will often allow terrible offenses to plead down to this level simply to avoid trial; many who actually raped a child do end up with a much lesser offense on their record. But it's that way for every type of crime.

If the crime is premeditated then sure, it passes through their heads. But then they come up with their plan for the perfect crime and brush that thought aside. This attitude only increases in magnitude as the heinousness of the crime increases. I'll admit that I've committed crime before, when I was younger. The potential punishments didn't mean shit to me right up until the moment I got caught, at which point the penny dropped; and it dropped far too late for me.

So-called "deterrence" might work if only to reassure people who wouldn't actually commit the crime that they shouldn't be committing said crime. I'm sure you've wished violence and death on people yourself in day-to-day living... everybody does. However, if somebody wants to murder somebody, and actually means to go through with it, then the fact they could be hung or shot if they were caught won't mean anything to them other than "Well, better make sure I'm not caught then".

There are two types of criminals: hobby and necessitous. The first one can be solved with plain therapy. They usually do it because it causes a rush, because it's fun. Rehabilitation can be achieved simply by working through the problems causing this kind of behaviour. Would a shoplifter or a burglar be better served or more useful to his community long-term by having his hands chopped off instead of that? The second one can be solved through education. The socio-economic influence in crime is clear: poverty breeds lawlessness. If you give the gang member an education; a trade, a work ethic and a chance, and they might escape the life of poverty and "crime to survive" that got them there in the first place.

Please note I'm talking about crime in general in this passage, and not specifically rape... but I think that even a majority of rapists and murderers can be rehabilitated and made useful to society and go on to have fulfilled lives* free of the demons that influenced them to such a degree that they commit such a horrible crime. Attitudes need to change if we want to quash crime. Capital punishment was only outlawed in the West in the last 100 years, which means that the previous 2,000 years in which capital punishment was in place utterly failed to stem the tide. We've outlawed the method but kept the mentality, and it's badly in need of an update.

I don't believe in deterrence strictly--I also see value in retribution, and mere incapacitation of a criminal for a period of time is useful in itself.

I'm very skeptical of rehabilitation. Partially this may be due to the fact that it's never really been attempted on a wide scale, but I've yet to see much evidence that there are specific steps the state can take to rehabilitate criminals. "Therapy"? There's not even much proof that therapy works to help people's depression or marriages (actually, going into marriage counseling is about the worst thing a couple can do if they'd like to stay married), let alone turning around a committed criminal who is undergoing such treatment involuntarily.

Even if there were, I question the economic efficiency of it. With limited resources, I would very much resent more state money going to talk about a sex offender's childhood as opposed to education or other services for people who have managed to not rape children. That's one of the arguments in favor of the sex offender registry, actually--it's pretty cheap.
