I remember you work in financial law so I have a question you might be able to assist me with.

Last weekend I got an MOT and major service. I booked it in a month before so several days before the car went in I had a pending payment on my credit card from the garage.

On Sunday I checked and noticed the pending payment had gone and no monies had gone. I assume the garage didn't collect the pending payment for some error.

Now I know I owe the money and I know I wouldn't be in any trouble if I ignored it as I can play ignorant but what do you think of the chances they'll notice and recharge my card?

It's almost £600 so I fancy keeping it.

Anyway that said yes you should absolutely try to keep it. You have got enough expenses with your £12 London pints.

It's definitely in error, the pre authorisation hold wasn't applied for before it settled and it expired. It's more common than you think.

They will also certainly notice, unless they literally don't care about making money. Their POS ledger will not match their balance, there will be a £600 discrepancy.

Even though it dropped, the debt still exists. The garage have 6 years to chase for it under Limitation Act 1980.

They may be able to reapply for the moneys on their terminal, or they will otherwise invoice/chase you. They will take you to small claims court if you don't pay the money.

The bottom line is, a business not noticing £600 missing from their balance is not going to happen. Keep that £600 available, because they will come for it sooner or later.

Don't tell them. They probably will notice but there's a non-zero chance they won't, so it's potentially free money. Never admit you knew, so it can't become unjust enrichment. Worst case, they ask and you pay (it's a civil issue, you won't have police banging on your door). Best case, free £600.
