Dude declined the settlement. I got a letter that i should expect to be sued soon.
No one was injured at the accident. Everyone was fine. So I assume it's soft tissue damage they are claiming.
What should I expect? Why didn't he just take the settlement? The accident was my fault, but he didn't get a police report (cop was there, but he was in a rush to get to class).
How fucked am I? I won't work to pay for someone faking injuries. I'll just kill myself after destroying/giving away all possessions.

I rear-ended them as they were slowing. I started to change lanes as cars were moving. A cop had pulled someone over ahead and so cars were trying to moved over, so that lane began to slow (or I really misinterpreted their speed). The roads were slick so I slid right into the back of them.
No police report, but Im def at fault.
I have no assets though. I think they will end up settling. No attorney is going to have their client pursue a case where they will end up paying more than they will realistically get.
It would be fun to seppuku on the dude's front lawn, though.

Did you have insurance and did you sign anything that the person you hit, his attorney, or his insurance company gave you?
Don't sign anything without talking it over with a lawyer. A lawyer is an expense you may think you can do without but you need one.
If you had insurance tell them you are getting sued, if it happens, and they will cover all the legal matters.

Yeah dude, why arent you letting your insurance handle it. If you're insured then i don't see how they can sue you. Their claim should be against your carrier.

Uh, no. The claim is against the driver because the driver is the one who actually hit the other guy. Insurance companies really only get sued by the other driver when they refuse to pay a legitimate claim.

My question is why is the insurance not involved. There's no reason for them to contact sluggy at all, nor for him to contact them.

With a minor accident, and your having insurance, there shouldn't be anything to worry about even if it does go to court. Your policy maximum has got to be well over what a person could realistically get for this.
Your insurance has been involved since the beginning, right? They'll have a lawyer handling this.
It could take a year or more for this to go to court, and nobody will hold out that long for something this minor. In the meantime, you might have to answer written questions (through the insurance co. lawyer), give a deposition, or provide financial documents. I doubt it'll get that far.
A police report isn't necessary or that meaningful really... it's just a guy writing down what the parties said happened. (Exception would be if you'd told the officer you were at fault and that was put in the report.)

Yeah, I'm kind of hoping they are involved and he just didn't mention it. I don't know who would make a settlement offer without talking to a lawyer or insurance first??

I have no assets, so nothing I need to worry about. The woman at the insurance company said she would like to take this to court. It sounded like they haven't offered the max as a settlement, yet.
I've only communicated through voicemails, but I'm not worried anymore. Her saying shed like to take it to court "for a number of reasons" makes me feel confident it wouldn't ever get there.

Though, the insurance company doesn't know I have the memory of a goldfish. I dont really remember the details, I didn't reallly write anything down except what I reported.
After shit like this happens I go into suicide mode and feel like it dorant matter what I do cause I'm gonna be dead soon anyway. It's my coping mechanism I guess.
