Everything I wrote in the OP is true. It's also true that there higher courts than the New York appellate court, take that however you like. The prosecutors were told by 5 judges that they may be sanctioned for bringing the case to trial. Think they're going to push it? The prosecution's closing arguments were essentially "we know we fucked up, please don't sanction us"
