1. He didn't try to overthrow the government. He called for a peaceful protest, which is explicitly outlined as legal in the Constitution. I don't know if you remember, but the nation was founded during peaceful protests against the British government for high tax's.
2. Nobody tried to kill Mike Pence except for all the false flag actors that were highered to make the protest look a lot more violent than it really was.
