I should clarify what I was saying though: there is only a precedent for immunity from civil cases. So far none for criminal cases. Therefore the appeal would need to be considered very carefully. My guess is the defense is not expecting to win the argument - rather they are just playing for time - not so stupid.

The other thing is, if immunity is not granted it opens up a can of worms, because then Clinton, Bush, Obama and Biden would also be vulnerable to prosecution for their war crimes.
