(CBS/WLKY) SHELBYVILLE, Ky. - Testimony continued Tuesday in the trial of a doctor accused of amputating a man's penis without consent. Phillip Seaton, a 64-year-old truck driver, is suing Dr. John Patterson, who performed the 2007 surgery that was initially meant to be a simple circumcision to relieve inflammation.
Patterson, a Frankfort urologist, told a jury that he saved Seaton's life when he amputated part of the man's penis after discovering a rare and deadly cancer.
"What I saw was not a penis. What I saw was cancer," Patterson testified in Shelby County Circuit Court.

Patients absolutely have the right to determine the course of treatment for any illness discovered. There could have been alternative courses of treatment, or he could have decided against treatment entirely, which is still his right.
Only exception is if there was reason to think the patient were about to die right then and that any attempt to gain consent would make his imminent death likely. Doesn't sound like that was the case.
I am curious how the surgeon didn't discover the cancer during the initial consultation.

With cancer, it's very common that there are multiple options for how it can be treated (surgery right away, try chemo or radiation first, etc.). Or he could decide he just wants pain meds and to die when the time comes (he is older, and clearly likes his penis a lot). It's his choice.
A surgeon is in no way qualified to make a decision on cancer treatment based on what he sees in surgery, anyway. There's a whole other specialty for that, and the decision-making process is hopefully a little more reasoned than, "lol cut it off dude."

I agree with cccuuunnttt completely on this one. All he had to do was wait for the guy to wake up and say "Hate to break this to you, but I found cancer. We can get rid of it today or you can seek alternate treatments." Instead he didn't get any consent at all, and as said before, a surgeon in the OR cannot diagnose and treat cancer right then and there. This surgeon fucked up big time.
Unfortunately, there really aren't any alternate treatments. Penis cancer is almost always treated with amputation, but consent is still needed.
