I didn't make this one, but I've made similar.
I don't know 100%, but I think it is generated.
The background is slightly suspicious, they all look identical which happens a lot on generations, and their bodies are flawless.
Nothing stands out as proof, and there were pictures like this before AI. It's possible it's real, with some touchup in photoshop.

The US copyright office isn't the final say on this. Although I think something like automatic public domain status will be the outcome after the dust is settled in courts over the next few years. Companies like Google and Facebook have an interest for things to be that way since they can't have everyone that unknowingly contributed to the training sets asking for royalties. We the public could also stand to benefit from the public domain status, but that's not what matters.
