I guess if you actively invaded Congressional offices, maybe a $200 fine and a one day suspended jail sentence. I think the punishment for January 6th should be like this:

You were outside the Capitol building: No punishment at all
You went in the Capitol but just in the lobby/public areas: $100 fine for tresspassing
You went in the offices and stole Nancy's podium: $200 fine for tresspassing
All of the above plus you threw stuff at the Capitol police: $200 fine and a one day suspended sentence.

Not doing something is typically not a crime. Unless you're a pilot or operating heavy machinery.
