Minichan BBS™ complies with the European Union's GDPR. The following applies only to Data Subjects legally resident in the European Union!

By submitting data to Minichan in the form of text and images as part of replies or posts ("threads", "topics") you are performing a "clear affirmative action" as defined by the GDPR ("Consent of the data subject means any freely given, specific, informed and unambiguous indication of the data subject's wishes by which he or she, by a statement or by a clear affirmative action, signifies agreement to the processing of personal data relating to him or her.") and thus you accept this data will be stored and processed by Minichan, in order for Minichan to display these replies or posts to other users; by pressing 'Submit', 'Post', 'Update', you are performing a "positive action" with the understanding Minichan will process your data for this "specific and obvious purpose", as clarified in the Consent Guidance of the United Kingdom Information Commissioner's Office: "The idea of an affirmative act does still leave room for implied consent in some circumstances, particularly in more informal offline situations. The key issue is that there must be a positive action that makes it clear someone is agreeing to the use of their information for a specific and obvious purpose. However, this type of implied consent would not extend beyond what was obvious and necessary."

When you visit Minichan, your IP address is stored on our server for security purposes. The GDPR allows for collection of personal data without explicit consent when collected for the purpose of a "legitimate interest" of the data controller: "Processing shall be lawful only if and to the extent that at least one of the following applies: ... (f) processing is necessary for the purposes of the legitimate interests pursued by the controller or by a third party."

Security purposes constitute a "legitimate interest" on the part of Minichan, as explained in Recital 49: "The processing of personal data to the extent strictly necessary and proportionate for the purposes of ensuring network and information security, i.e. the ability of a network or an information system to resist, at a given level of confidence, accidental events or unlawful or malicious actions that compromise the availability, authenticity, integrity and confidentiality of stored or transmitted personal data, and the security of the related services offered by, or accessible via, those networks and systems, [...] by providers of electronic communications networks and services and by providers of security technologies and services, constitutes a legitimate interest of the data controller concerned. This could, for example, include preventing unauthorised access to electronic communications networks and malicious code distribution and stopping ‘denial of service’ attacks and damage to computer and electronic communication systems."

Under Article 17 of the GDPR you have the right to have your personal data erased, under certain circumstances. You may make a request to Minichan's administration by emailing [email protected] if you believe you have a valid reason for requesting removal. Under Article 12(5)(a) Minichan has the right to reject your request or charge a "reasonable fee" if we consider your request to be manifestly unfounded or excessive.

By using Minichan, you consent to Minichan placing cookies in your browser.
